Terms of Business Agreement

Goods or Services provided

D Page Contractors Ltd are contracted to provide the supply and/ or installation of Ground Screw Pile Foundations.

All installers working on behalf of D Page Contractors Ltd have the necessary experience and abilities to instal Ground Screw Foundations. D Page Contractors Ltd are agreeable to providing such services to a client based on the terms and conditions set out in this document.

Payment terms

Ad hoc works carried out by D Page Contractors Ltd are invoiced at 100% prior to works commencing, unless prior agreement by management has given special arrangements on this term. Commercial contracts are invoiced following completion of works and require payment in full immediately, unless special arrangements have been agreed by management.

D Page Contractors Ltd reserve the right to pass unpaid balances to legal representatives in cases of no or under payment. This is reviewed on a case-by-case basis.

D Page Contractors Ltd will make a charge of £450 + VAT for any lost days’ work in the event of any site not being immediately ready for works to commence on our arrival.

Pricing terms

D Page Contractors Ltd use various pricing tariffs. Tariff placement is determined by several factors and will remain the decision of management only. D Page Contractors Ltd reserve the right to keep tariff banding confidential but will provide estimates on a case-by-case basis or band appropriate price lists for commercial accounts.

D Page Contractors Ltd cannot guarantee final invoices will always match initial estimates given the many variables that can arise on site.

Estimates or pricelists provided by D Page Contractors Ltd Ltd are in GBP and are exclusive of VAT, delivery, transport or any other levies unless specified. It is the customers responsibility to advise if they are VAT or CIS registered

Service Delivery

D Page Contractors Ltd generally have a 30 day lead time which is clearly communicated from enquiry stage. Staffing levels are closely monitored to ensure installations are carried out in their entirety on agreed days. In the rare event this cannot be met, management will discuss with the relevant site contact to make alternative arrangements and if necessary, agree to cover reasonable costs which must be submitted in writing.

Compliance and regulation

D Page Contractors Ltd ensure all installers are kept up to date in their understanding and compliance with relevant legislation including but not limited to;

Management of Health and Safety at Work Regulations 1999.

Provision and Use of Work Equipment Regulations 1998.

Health and Safety (Display Screen Equipment) Regulations 1992.

Manual Handling Operations Regulations 1992.

Personal Protective Equipment at Work Regulations 1992.

D Page Contractors Ltd relinquish ownership of goods at the point of install and once full and final payment has been made. Should improper use render the goods ineffective or cause damage, D Page Contractors Ltd will not be held responsible for any damage or consequential loss suffered.

Data Protection

All data provided to D Page Contractors Ltd is treated in the strictest confidence in accordance with The Data Protection Act 2018. Any data sent to us in relation to the project, remains in our systems for 7 years pursuant to any potential claims made against the company.

Dispute Resolution

Should a situation arise where a customer is dissatisfied with the service provided, details of the complaint should be sent to Operational Management in the first instance. You have the right to appeal this decision should you remain unsatisfied. Appeals will be handled by the Managing Director only. Should you remain unsatisfied you have the right to contact the consumer ombudsman service.

Following install, a customer has the right to raise a complaint for 14 days. If complaints are made later than the 14-day period, the customer is no longer entitled to repair, replacement or compensation. Any defects found do not give the right to reject the work delivered in its entirety.

The handling of a complaint does not count as acceptance of damage, liability or fault.

The Client remains obliged to purchase and pay for the purchased goods and/or services. If the Client wishes to return any defective goods, this can be done only with our approval.

If a complaint from the Client is accepted and agreed, D Page Contractors will rectify the works or, refund the contract price by crediting the amount of that (partial) performance.

If a fault is found due to improper use, D Page Contractors Ltd will not uphold any complaint made.
